Welcome to Blue Marlin Dive Komodo. Please read these Terms and Conditions carefully before using our website or engaging with our services. 


1. Acceptance of Terms

By accessing and using the Blue Marlin Dive Komodo website, placing a booking, making payments, you accept and agree to be bound by these Terms and Conditions, including our bookings, cancellation,refunds and privacy policies. 


2. Changes to Terms

Blue Marlin Dive Komodo reserves the right to change, modify, or update these Terms and Conditions at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of those changes.


3. Services

Blue Marlin Dive Komodo provides diving courses, daily dive trips (including Liveaboard), snorkelling, equipment rentals, and/or related services ("Services"). All Services are subject to availability and is conditional upon receipt of full payment. For the avoidance of doubt, 'full payment' includes the payment of the price of the Services, the Komodo National Park & Harbour fees, and the local government tax (where applicable).


The Komodo National Park Requirements

  • Guests must provide required documents for applications of clearance with the Harbour Master's office.
  • Approval is not guaranteed and late submissions may be rejected. Blue Marlin Komodo is not responsible for any such rejection by the Harbour Master's Office.
  • Adherence to Indonesian, local government and the Komodo National Park Authority's SOPs and health protocols is mandatory. 

4. Booking and Payments


Booking Confirmation

  • Bookings of Services are confirmed only upon receipt of deposit/full payment.
  • Bookings are subject to availability and may be declined if payment is not received within the required timeframe. 


Payment Methods

  • We accept payments via credit card, domestic bank transfer, PayPal (only USD, subject to a 5% PayPal fee), and WISE transfer (IDR).
  • Any banking or administrative fees are to be paid by the guests.
  • Credit card payments are subjected to a 3% surcharge.

Deposits and Balances

  • A 25% non-refundable deposit is required for daily dive trips, dive packages and snorkeling. 
  • A 25% or an amount equal to one night stay (whichever is higher) is required as a non-refundable deposit for accommodation.
  • Liveaboard bookings require a 30% non-refundable deposit, and the balance is to be paid 45 days before the departure date. 
  • Private charters require a non-refundable 35% deposit, and the balance is to be paid 45 days before departure. 
  • For the avoidance of doubt, the deposit is not refundable, not transferable between divers and is not transferable within the Blue Marlin dive shops.
  • The balance payment for daily dive trips, packages, snorkelling trips, and PADI courses can be paid at any time but must be paid to Blue Marlin Komodo by 4pm at the very latest, one day before the commencement of the diving and/snorkelling and/or PADI course, unless expressly stated otherwise. If for whatever reason, the balance is not received by 4pm on the day before the commencement of the activity, Blue Marlin Komodo is not able to guarantee the availability of dive trip, PADI course and/or boat slots.

Cancellations and Refunds

  • At Blue Marlin Dive Komodo, we strive to provide the best experience for our customers. We understand that sometimes plans change, and we aim to be as accommodating as possible while maintaining fairness in our policies.


  • Different cancellation policies may apply to each booking category, and the guest(s) are deemed to have agreed to the specific cancellation policy upon booking. 

General

  • Guest will NOT receive a refund for no shows or any cancellation of Services communicated to Blue Marlin Komodo AFTER 4pm the day before the trip.
  • In the event that a guest has paid a deposit or a higher amount and cancels BEFORE 4 pm on the day preceding a trip, the guest(s) will only receive a refund for payment made beyond the deposit (i.e. the deposit is not refundable).
  • Blue Marlin Komodo does not offer refunds in the event of natural disasters, personal injury, airplane delay/cancellation, unforeseeable mechanical/technical breakdowns, strikes, war, criminal acts, quarantine, acts of God, or any other event beyond its actual control, and for any other than for reasons set out below in Force Majeure.
  • Blue Marlin Komodo will give a full refund (less any bank fee and/or administrative and VAT) in the event of a closed port situation, bad weather to the extent that it makes the activities unsafe or dangerous, or prohibited by the harbour master or if, for any reason Blue Marlin Komodo itself cancels a trip or course; or if Blue Marlin Komodo has less than 4 people scheduled for the liveaboard. However, rainy and/or cloudy weather are not valid reasons for cancellation that would entitle the guest a refund.
  • Blue Marlin Komodo and the dive guides on the boat may refuse service and prohibit participation on dives at their discretion based on lack of respect for ecological rules and regulations, lack of respect - or “handling” of any marine life, alcohol consumption between dives, blatant disregard for Blue Marlin Komodo’s policies or not abiding by international safe diving rules. In this instant, Blue Marlin Komodo will not offer any refund for the missed or cancelled dives
  • Please book refundable hotel and flights as those expenses will not be refunded by Blue Marlin Komodo, for example delays, cancellations, flight schedule changes. Blue Marlin Komodo is not the operator of any of the hotels or accommodation booked and therefore, disclaims any responsibility for the quality, safety, or availability of hotel services and amenities. The carriers’ and hoteliers’ terms and conditions apply and liability remains entirely with the carrier and hotelier, respectively.  
  • Save and except as expressly stated in this Terms and Conditions, no refund or compensation will be payable by Blue Marlin Komodo for any unused portions of a trip OR if the guest have any equalisation issues and/or inability to dive due to anxiety or nervousness. Guest who do not complete their diving trips for any reason are not entitled to a refund for a portion of the total costs.  

PADI Dive Courses

  • It is possible to fail and/or not complete a course; failure or inability to complete the course does not qualify for a full refund.
  • The instructor will determine if the guest may be certified or not, based on whether the said guest meets the requirements of the particular course (skill demonstration, comfort level in the water and total dive skills) and the score on the written examination and quizzes. Refunds will only be given for PADI training course modules that were NOT completed by the guest. 
  • For the Open Water Course, the following will apply for each completed section:

i) Theory modules : 250.000 IDR per module (max of 5 modules);

ii) Confined sessions : 250.000 IDR per module (max of 5 modules); and

iii) Open Water dives : 1.350.000 IDR per dive (max of 4 dives).

  • For all other PADI Courses, any refunds for the non-completion (if any) will be subject to the assessment and determination of the instructor.
  • The PADI courses are offered in good faith. If for whatever reason, guest missed a training session, there will be NO refund for the missed session; the missed training session may be rescheduled subject to availability.
  • No refunds for PADI materials (eLearning) purchased by Blue Marlin Komodo for courses; these can be used at any PADI Dive Centre worldwide.

Liveaboards

  • Deposits and any payment made for the liveaboard are not refundable, and not transferable.

Private Charter

  • The private charter of our boats cannot be cancelled and there shall be no refund as Blue Marlin Komodo has accepted your commitment to use the boat in its entirety and has lost the use of the chartered boat. 

5. Diving Courses

  • Prerequisites: Participants must meet all prerequisites as listed for each course.
  • Medical Conditions: Participants must disclose any medical conditions that may affect their ability to dive. A medical clearance from a doctor may be required.
  • Safety Standards: All courses are conducted in accordance with PADI, TDI, and IART standards. Participants must follow all safety instructions provided by our instructors.


6. User Accounts

  • Account Creation: To access certain features of our website, you may be required to create an account. You agree to provide accurate and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.
  • Account Usage: You agree that you will not use another user’s account without their permission. You are responsible for all activities that occur under your account.
  • Account Termination: Blue Marlin Dive Komodo reserves the right to suspend or terminate your account if you violate these Terms and Conditions or engage in any activities that harm the website or other users.


7. Liability

  • Assumption of Risk: Diving and related activities involve inherent risks. Participants assume all risks associated with diving activities.
  • Release of Liability: By participating in our diving courses and activities, participants release Blue Marlin Dive Komodo, its instructors, and affiliates from any liability for injury, loss, or damage.
  • All itineraries are subject to various unpredictable changes including weather conditions and government approvals. Whilst Blue Marlin Komodo makes every effort, we cannot guarantee diving at specific dive sites. In adverse weather conditions, the guides and captain of the boat will have the final decision as to which dive sites to visit to ensure the guest, staff and boats safety is not compromised in any way. If, in the unfortunate event that itinerary is changed and dives are missed/cancelled or dive sites are not reached due to weather conditions or other unforeseeable changes, Blue Marlin Komodo shall not be liable and will not offer a refund or compensation.
  • In case of a medical problem arising during voyage, either on board or on shore, which results in costs for evacuation, use of aircraft or repatriation, the responsibility of payment of these costs belongs solely to the guest(s). If a person requires emergency evacuation and the boat must return to land, Blue Marlin Komodo shall not accept any financial responsibilities for any ensuing itinerary changes.
  • Blue Marlin Komodo does not accept any liability whatsoever to guest or for any loss or damage to their luggage, personal belongings or dive equipment including but not limited to camera and lighting equipment while transferring to and from the boat or while being on board or while being stored at Blue Marlin Komodo’s facility. Blue Marlin Komodo’s liability under any circumstances (if any) is limited to a 100% refund of the payment made. Blue Marlin Komodo will however help guest in every possible way with insurance claims for the lost or damaged goods.
  • Guest agree to pay compensation at full current market value to Blue Marlin Komodo for all and any damage or loss of property and equipment belonging to Blue Marlin Komodo resulting from abuse and/or negligence on their part.
  • The guest must declare at the time of reservation that they do not suffer from any mental, physical, or other, disability that may put them, or other passenger at risk. Blue Marlin Komodo reserves the right to refuse the contracted services to a guest presenting these risks during a charter and/or activity.
  • Blue Marlin Komodo, its partners, affiliates, agents, and employees shall not refund any payment and/or be responsible or liable in contract or in tort, for all and any injury to person (whether or not resulting in death), damage, loss, delay to person or property, additional expenses or inconvenienced caused directly or indirectly by Blue Marlin Komodo arising out of any act or war, insurrection, revolt or other civil uprising or military action, Acts of God (including but not limited to fire, flood, earthquake, storm, hurricane, or other natural disaster), war, political unrest, ad other hostilities (regardless whether war is declared), pandemic, epidemic, government regulations or policies or any technical difficulties occurring in the country of destination or during the passage.
  • Blue Marlin Komodo recommends all guests to hold an adequate level of travel/diving and cancellation insurance policy that covers for unforeseen circumstances, cancellations charges, medical, personal injury and liability, loss of baggage/money and Covid-19 or any other pandemic restrictions such as border closures.


8. Intellectual Property

  • Ownership: All content on the Blue Marlin Dive Komodo website, including text, graphics, logos, and images, is the property of Blue Marlin Dive or its content suppliers.
  • Use of Content: You may not use, reproduce, or distribute any content from our website without prior written permission from Blue Marlin Dive Komodo.


9. Privacy


At Blue Marlin Dive Komodo, we are committed to protecting your privacy and ensuring that your personal information is handled securely. This section outlines how we collect, use, and protect your data.

i. Information We Collect
